These Terms and Conditions govern your use of the Grace Care website located at www.grace-care.com.au and your engagement with Grace Care’s NDIS support services across Greater Sydney, NSW.
By accessing our website, submitting an enquiry, or entering into a service agreement with Grace Care, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please discontinue use of our website and contact us before engaging our services.

About Grace Care

Grace Care Pty Ltd (ABN available on request) is a registered NDIS service provider based in Seven Hills, New South Wales. We deliver a comprehensive range of NDIS disability support services to participants and families across Greater Sydney.

2. Website Use

2.1 Permitted Use You may use the Grace Care website for lawful purposes only. The website is intended to provide information about Grace Care’s services, facilitate enquiries, and support participants and families in accessing NDIS support across Greater Sydney.

2.2 Prohibited Use You must not use our website to:
Post, transmit, or distribute unlawful, defamatory, offensive, or harmful content. Attempt to gain unauthorised access to our website systems, databases, or user accounts. Introduce viruses, malware, or other harmful code to our website or systems. Collect personal information about other users without their consent. Reproduce, copy, or redistribute website content without Grace Care’s written permission. Use the website in any manner that could damage, disable, overburden, or impair its functionality.

2.3 Website Availability Grace Care endeavours to maintain continuous website availability but does not guarantee uninterrupted access. The website may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. Grace Care accepts no liability for loss or inconvenience caused by website downtime.

4. NDIS Services and Service Agreements

4.1 Service Agreements All NDIS support services delivered by Grace Care are governed by a formal Service Agreement entered into between Grace Care and the participant or their authorised representative. These Terms and Conditions apply alongside, and do not replace, the participant’s Service Agreement.

4.2 NDIS Eligibility Grace Care’s funded NDIS services are available to participants with an active NDIS plan containing relevant funding. It is the participant’s responsibility to confirm that their NDIS plan includes appropriate funding for the services they wish to access. Grace Care will assist participants to understand their plan during the intake process but cannot guarantee NDIS funding approval or outcomes.

4.3 Service Delivery Standards Grace Care delivers all services in accordance with the NDIS Practice Standards, the NDIS Code of Conduct, and any other applicable regulatory requirements. We are committed to delivering safe, quality, and participant-centred support at all times.

4.4 Service Changes and Cancellations Participants or their representatives wishing to change, suspend, or cancel services must notify Grace Care in accordance with the notice periods specified in their Service Agreement. Grace Care reserves the right to vary or cease services where continued delivery is unsafe, impractical, or not in accordance with the participant’s NDIS plan.

4.5 Fees and Charges Grace Care charges for services in accordance with the NDIS Pricing Arrangements and Price Limits published by the NDIA. All fees are outlined in the participant’s Service Agreement. Grace Care reserves the right to update its fees in line with NDIS Pricing Arrangement changes. Participants will be notified of any fee changes before they take effect.

4.6 NDIS Plan Management Participants are responsible for ensuring their NDIS plan contains sufficient funding to cover agreed services. Grace Care is not responsible for funding shortfalls arising from participant plan management decisions or NDIA funding determinations.

5. Participant Rights and Responsibilities

5.1 Participant Rights Every participant accessing Grace Care’s services has the right to:
Receive safe, quality support delivered with dignity and respect. Be treated without discrimination on any basis including race, gender, age, disability, religion, sexual orientation, or cultural background. Make informed decisions about their support and exercise genuine choice and control over their NDIS plan. Provide feedback about service quality and have complaints addressed promptly and fairly. Access information Grace Care holds about them in accordance with our Privacy Policy. Withdraw from services at any time in accordance with the terms of their Service Agreement.

5.2 Participant Responsibilities Participants and their representatives are responsible for:
Providing accurate and complete information about support needs, health conditions, and relevant circumstances during the intake process and throughout the service relationship. Notifying Grace Care promptly of any changes in support needs, health status, living arrangements, or NDIS plan details that affect service delivery. Treating Grace Care staff with respect and courtesy at all times. Ensuring the home and support environments are safe for support workers to operate in. Complying with the terms of the Service Agreement including agreed notice periods for cancellations and changes.

6. Cancellation Policy

6.1 Participant Cancellations Participants or their representatives must provide notice of service cancellations in accordance with the timeframes specified in their Service Agreement. Where insufficient notice is provided, Grace Care may charge a cancellation fee in accordance with the NDIS Pricing Arrangements for short notice cancellations. 6.2 Grace Care Cancellations In the event that Grace Care is unable to deliver a scheduled support session due to staff unavailability or other operational circumstances, we will notify the participant or their representative as early as possible and work to arrange an alternative support arrangement where feasible. 6.3 Force Majeure Grace Care is not liable for failure to deliver services caused by circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather events, government-mandated restrictions, public health emergencies, or other force majeure events.

7. Complaints and Feedback

Grace Care is committed to resolving complaints promptly, fairly, and transparently. 7.1 How to Make a Complaint Complaints can be submitted by phone on 1300 069 338, by email to info@grace-care.com.au, or in writing addressed to the Operations Manager at 1 Redman Lane, Seven Hills NSW 2146. 7.2 Complaints Process We will acknowledge receipt of your complaint within two business days. We will investigate the matter thoroughly and provide a written response within 14 business days. The user is informed that the company maintains the right to block and/or terminate the user’s access and use of its services if the user fails to comply with the terms of these Terms of Service and/or Drizly finds the user’s behavior to be illicit or inappropriate or malevolent.
